Brand Terms

Introduction
These brand (“Terms”) govern the relationship between brand partners (“Brands”) and The Beauty Spectrum (“Platform”). By offering courses or training on the Platform, brands agree to comply with these Terms, which include provisions regarding course creation, content management, financial arrangements, marketing rights, and other relevant aspects of providing brand education on the Platform.
1. Course Creation and Management
Quality Standards: Brands are responsible for creating and managing their course content, ensuring that it meets the Platform’s quality standards and adheres to applicable educational guidelines.
Content Updates: Brands are expected to keep their course materials up-to-date and relevant, making necessary adjustments or additions as required.
2. Brand Conduct
Accurate Representation: Brands must provide truthful and accurate information regarding their products and business when signing up on the Platform. Any misrepresentation of experience, product performance, or company details is strictly prohibited and may result in the termination of the Brand’s account.
Quality of Instruction: Brands are responsible for ensuring the quality and educational value of their courses. This includes creating comprehensive, well-structured, and informative course materials that align with the subject matter and stated objectives.
Regular Updates and Responsiveness: Brands are expected to keep their course materials up-to-date and respond to inquiries in a timely manner.
Non-Discrimination: In providing courses and interacting with students, Brands must adhere to principles of non-discrimination and equality, ensuring that all students have equal access to educational resources and opportunities.
Prohibited Content: Brands must not include any content in their courses that is obscene, defamatory, racially or ethnically offensive, or in any way violates the Platform’s content guidelines or applicable laws.
Failure to adhere to these obligations may result in the removal of the Brand’s content from the Platform, suspension, or termination of the Brand’s account, and/or other legal actions as deemed necessary by the Platform.
3. Intellectual Property
Ownership: Brands maintain ownership of the content they create, subject to the Platform’s rights to use, distribute, and promote the courses as outlined in these Terms.
License to Platform: Brands grant the Platform a non-exclusive license to use, reproduce, distribute, and display the course content in connection with the Platform’s services.
Marketing Rights: The Platform reserves the right to use the Brand’s name, likeness, course titles, product imagery, and associated content for marketing, promotional, and advertising purposes. This may include but is not limited to featuring courses in emails, advertisements, and social media promotions.
4. Financial Terms
Revenue Sharing: The Platform charges a commission of 5% on each course purchase/enrollment. The remaining 95% of the course fee is payable to the Brand.
Hosting Fee: As of December 1st, 2024, The Beauty Spectrum charges brands a monthly hosting fee depending on the tier they select. The Brand is expected to maintain their fee to keep their courses active on The Beauty Spectrum platform. Failure to stay current with the hosting fee may result in the course being temporarily deactivated or removed from the Platform until the balance is settled.
Payment Process: Payments to Brands will be made in accordance with the Platform’s payment schedule and procedures. Brands are responsible for providing accurate payment information and for any taxes associated with their earnings.
As a platform, we’ve integrated Stripe Connect to handle the transactional aspect of our business smoothly. This means that when customers pay for goods or services through our platform, Stripe Connect ensures that the funds are transferred directly to you in a timely manner. You can trust that your payments are processed securely and that you’ll receive your earnings without any hassle. Plus, Stripe Connect provides transparency, allowing you to track your payments and manage your finances.
Processing Fees: Stripe takes out processing fees from brands when a payout occurs. This is based on the amount of money being deposited. Brands will be able to see the exact amount through their Stripe account.
Refund Policy: Brands must adhere to the Platform’s refund policy, as outlined in the general Terms of Use.
5. Termination
Termination by Platform: The Platform reserves the right to terminate a Brand’s access to the service for breach of these Terms or for conduct that is harmful to the Platform or its users.
Termination by Brand: Brands may discontinue their use of the Platform in accordance with the Platform’s procedures for course removal and account closure.
6. Dispute Resolution
Process: Any disputes arising under these Terms will be resolved through the Platform’s dispute resolution process, which may involve mediation or arbitration.
7. Amendments to Terms
Changes: The Platform reserves the right to modify these Brand Terms at any time. Continued use of the Platform by the Brand after such changes constitutes acceptance of the new terms.
8. Acceptance
Agreement to Terms: By creating and offering a course or training on the Platform, the Brand agrees to be bound by these Terms.
