SERVICE AGREEMENT FOR COURSE ENROLLMENT

This Service Agreement (“Agreement“) is a binding contract between the instructor (“Instructor“) providing courses and the student (“Student“) enrolling in courses on The Beauty Spectrum (“Platform“). By enrolling in a course, the Student agrees to be bound by the terms of this Agreement, and the Instructor, by offering a course on the Platform, agrees to adhere to these terms.

1. Scope of Services

Course Provision: The Instructor to provide educational services, which include, but are not limited to, delivering lectures, providing instructional materials, and offering student support, in accordance with the descriptions and outlines provided on the Platform.
Course Enrollment: The Student agrees to enroll in courses following the Platform’s enrollment procedures. The Student is responsible for ensuring that they meet any prerequisites or qualifications required for the course.

2. Obligations of the Instructor

Standard of Instruction: The Instructor committed to providing high-quality, accurate, and professionally standard educational content. This includes ensuring that the course content is up-to-date and relevant to the subject matter.
Platform Compliance: The Instructor must comply with all policies, guidelines, and regulations set forth by the Platform, including content standards, data protection policies, and any applicable legal requirements.

3. Obligations of the Student

Engagement and Participation: The Student agrees to engage actively in the course, which includes completing assignments, participating in discussions, and adhering to any course-specific requirements.
Conduct: The Students must conduct themselves in a manner that is respectful to the Instructor and fellow students, in line with the Platform’s Community Guidelines and Code of Conduct.
Financial Commitments: The Student is responsible for the timely payment of any course fees, in accordance with the Platform’s payment terms and conditions. This includes adhering to the specified payment schedule and understanding the refund and cancellation policies.

4. Intellectual Property

Instructor’s Rights: All course materials provided by the Instructor, including but not limited to videos, documents, and other resources, remain the intellectual property of the Instructor respective rights holders.
Student’s License: The Student is granted a non-exclusive, non-transferable license to use the course materials for personal and non-commercial educational purposes only. This license is subject to revocation upon violation of this Agreement.

5. Termination

Platform’s Right to Terminate: The Platform reserves the right to terminate this Agreement and the Student’s access to the course for violations of Platform policies, this Agreement, or applicable laws.
Instructor or Student’s Right to Terminate: The Instructor or Student may terminate this Agreement in accordance with the Platform’s cancellation and refund policy, which should be consulted for specific terms and conditions.

6. Dispute Resolution

Process: In the event of a dispute arising from or in connection with this Agreement, the Parties agree to participate in good faith in the dispute resolution process provided by the Platform. This may include mediation or arbitration, as stipulated by the Platform.

7. Amendment and Modification

Changes to Agreement: This Agreement may be amended or modified by the Platform, with appropriate notice to both the Instructor and the Student. Continued use of the Platform or participation in courses after such changes constitutes acceptance of the new terms.

8. Governing Law

Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of Florida applicable to agreements made and to be entirely performed within the State of Florida, without regard to its conflict of law principles.

9. Acknowledgment and Acceptance

Binding Agreement: By enrolling in or offering a course on the Platform, the Student and Instructor respectively acknowledge and agree to be bound by the terms of this Agreement.
